EB1A or NIW ? Post Doctoral Researcher
Published Sep 16,2021
By Mike
Hi,
I would like to know if I am eligible for EB1-A
Publications – 30
Reviews – 23; served as Session Chair for a Technical Conference
Patent – 1
Filed – Aerospace Structures ( Prognostics of Composites )
Many Attorneys suggest NIW and to wait 2 more years. However given my field, I feel that I may apply. Would like to do self-petition.
Thanks

Hi Mike,
How many citations do you have and in how many of those publications are you the first author?

Hi,
I have 62 citations, and 16 publications are first authored. I also co-authored a book chapter
Low citation count is probably the main obstacle for EB1A. 16 first-author publications is very good.

Hi,
Recently I came to know that, typically all PhD’s due to the nature of the role and the organization which they work, can be able to include “Critical Role” – ” Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;” ? Is this true and to what extent do you recommend this for a Post Doc Researcher – at a top university. what kind of evidence are required for this ?
Yes, it is possible. The simplest 3 criteria to satisfy for postdocs are (1) original scientific contributions of major significance; (2) judged the work of others; (3) evidence of authorship of scholarly articles. However, if you have a strong evidence of the leading/critical role in an organization, it can be added, too.
The most logical way to use it is to show that your work (1) is of major significance to the field (2) enjoys sustained national or international acclaim.

Speaking of evidence, please have a look at the following document from USCIS:

Thanks. Finally, Which category will ” Invited Seminar Talks ” Fall into ?
