Do EB2 niw provide ead for working?

Published Jan 11,2020 By H

Hi,

I am from India and I have a PhD from outside US. I  filewant to for a EB2 NIW and have a question about work authorization after that. Say my application gets accepted, will I receive an ead card that allows me to work in US? Do I have to wait until my priority date becomes current( which will take few years because I’m from India) for the ead card or does it arrive soon?

Thanks a lot!

Hello,

Yes, you would have to wait for your priority date to become current before filing for EAD

Hi, GC4PhD team:

I was interested to purchase the service while I have one question before making the decision. In the case that I apply EB2 NIW or EB1A under H4 status within US, if my I-140 approved, then can I get EAD card to work in US? I think that’s a slightly different question to the above. My spouse is a H1B worker but he doesn’t qualify for either while I have a liberal art PhD from a US university. It still takes my spouse sometimes to have his I-140 approved and I really want to take the advantage of my publications to file I-140 and get EAD for myself. Let me know if you have any prior experience on this. (our I-485 is not current and need wait for around 3 years)

Approved I-140 does not make you eligible for EAD, only pending I-485 does
