Employer sponsored EB1A – File I485 using previous employer I140

Hello,

My employer sponsored my EB1A and I got my I 140 approved. I changed jobs recently. Since EB1A is not employer dependent, I was wondering if I can utilize the I140 that was approved to file I 485 although it was employer sponsored.

Hello Balaji,

Congratulations on the successful EB1A case! Yes, you can change jobs and file I-485 even if your case was sponsored by an employer. Please keep in mind that the new job should be in the same field, because your employment should be consistent with the story you presented in the I-140 petition (otherwise it might be questioned at the I-485 interview). If you don’t mind, could you please let us know how many citations you had prior to filing I-140? I am trying to get an update on the current USCIS requirements.
