Questions for NIW evaluation
Published Dec 24,2018

Hi all,
I’m currently F-1 PhD student in US and focus on stem cell, diabetes and regenerative medicine. I have 4 peer reviewed papers (3 first author) with high impact factor (two of them are over 20), around 60 citations, no reviews. Plan to graduate in one year and to apply for EB2-NIW once get my PhD. I have some questions about the future plan:
Is the research record good enough for NIW application? I prefer to go to industry but won’t expect have good publication there if what I have now is not enough.
Would you suggest me to apply for H1B first then NIW or apply for them at the same time?
Will I be able to renew my visa back in home (F1 OPT) while applying for NIW?
Thank you in advance!

Hi CZXH,
Before I answer the questions, please let us know in what country you were born (timing of the process depends on that crucially, if, say, you were born in India or China).
Thank you for the answer. Your field as well as credentials should help you to prepare a good NIW case. However, there is more than 3 years waiting time for Chinese nationals, please see the link below. In other words, if your I-140 is approved, you will need to wait for several years before you will be eligible to file I-485. In this case, it makes sense to get H1B (you can apply at any time), because you may not be able to extend F1 once I-140 is filed (it is because of the conflict of immigration/nonimmigration intents).
