J1 Waiver Decision

Dear Sir/Madam,

My J1 status has the two year home country requirement. On the basis of “No Objection”, I applied for a waiver, and the current status of my application at the DoS is “Favorable Recommendation”.

I understand that the USCIS has to make the final decision.

My question is this: must I wait to hear from the USCIS, or  can I already go ahead and make my adjustment of status application? Please advise.

Dear Emmanuel,

To my knowledge, you can already file adjustment of status documents at this stage. To be more updated about the current USCIS practices, please consult with an immigration lawyer (the first consultation is free for most of them, and this is all you need).
