Travel with valid J1 visa and pending/approved I-140

Published Jan 17,2023 By Bob

Hello,

I’m in the US on a valid J1 visa without the two year rule.
I recently applied for EB2-NIW and submitted the I-140. I haven’t submitted the I-485.

Will I be able to travel outside the US and re-enter with valid J1 visa and pending/approved I-140?

Thank you

Yes, you should be able to travel and re-enter the U.S. on J1 as long as you did not file I-485

Could it be a problem to travel with approved I-140 and current priority date? (On J1 visa)

Thanks

To my knowledge, it is not a problem to travel with existing J1 visa stamp and approved I-140. However, you should be careful about re-entering the U.S. on J1 and immediately applying for adjustment of status.
