Clarity about DIY Packet

Hi there,
I just ran across your website a few days ago, been reading up on it since. I have a PhD in Chemistry, based in South Africa with 8+ years work experience in the field (and a number of publications to go along). I am interested in the EB2/NIW visa, but I’m not certain which DIY Packet would be most useful to me. I read somewhere one can apply while he or she is outside of the US, but then again the information available on the site suggests one has to be in the US at the time of applying. Please clarify this apparent confusion for me, and also advise the most appropriate DIY Packet that I would benefit from.

Hi Chitty,
You don’t have to be in the U.S. in order to file your I-140 petition. Our DIY-packets will work in your case, too. The only difference is that you will need to do a consular processing instead of the adjustment of status when your I-140 is approved.

Just for further clarity, step 1 of the process is to submit the I-40?
Yes, Step 1 is filing I-140, and Step 2 is either applying for adjustment of status (if you live in the U.S.) or applying for consular processing (if you live outside U.S.). Applicants that live in the U.S. sometimes can do Step 1 and Step 2 simultaneously.

Good luck! Let us know if you have any issues with delivery of the kit (sometimes we need to resend it manually).
