EB1/EB2 for Psyd
Published Mar 14,2018

I am an Indian Student on F1. I graduate from Psyd in June 2018. I have a job offer for my post doc. I will be applying for OPT and getting my EAD. While in college I have worked for 3 organization for 3 years, created my dissertation, published a book, presented a poster at a conference, have several recommendation letters from coworkers, professors. My book and dissertation was original work.
My questions are:
Do I quality to self petition my Green card under EB1A/B?
If I don’t quality for EB1, then can I live and work in US while I wait for my application to be current under EB2?
Can I self petition under EB1 and EB2 NIW at the same time?
Thanks.

Hello,
The information you provided is not enough to tell if the USCIS criteria for EB1A are met. For example, published papers, order of authors, citation counts etc. should be taken into account. Please have a look at the free e-book by the link below. http://www.greencardforphd.com/free-ebook
You can work and live in the U.S. after filing I-140 as far as your visa status is valid. Pending or approved I-140 does not allow to stay and work. Please keep in mind that once you file I-140 you may not be able to extend the non-immigrant visas, such F-1/J-1 because of the conflict of intents. You still should be able to obtain the dual intent visas, such as H-1B/O-1.
Yes, you can self-petition under EB1 and EB2-NIW at the same time.
