i140 petition and EAD


If I get my petition approved but my cut off date is not current, do I have an EAD ? Is there any advantage of just getting the petition approved?

    If your I-140 is approved and your priority date is not current then you would not be able to apply for I-485. You can only avail EAD and advanced parole along with (or after applying for) the I-485 application. The advantage you have of getting your petition approved is that you have an early priority date. If you waited longer you would have a later priority fate.
