I have done Master’s in Mechanical Engineering in 2000 and now pursuing my Doctorate from India, already completed 3 years. I am doing Ph.D in Heat transfer area and have 18 years of experience in industry in field of CFD. I already have few appreciation letters and reco letters and few publications with 14 citations. Before purchasing you DIY, I would like to get fairly similar petition so that I can take advantage to create one for myself. Pl. let me know whether it would be beneficial to apply for EB2 NIW at this stage.

Hi Rahul,
Please have a look at the NIW criteria at our website (see the first link below). It would make sense to try NIW after graduation or earlier if you feel you can satisfy those criteria. However, if you were born in India (were you?), then there is a serious obstacle with this type of green card, since the procedure is backlogged. The priority date for the Indian nationals is 15SEP08 (see the second link below), meaning that only persons who filed their I-140 before that date are currently eligible for the adjustment of status. In other words, even if your I-140 NIW petition is approved, you will have to wait for many years before getting the actual green card.
