Does approved EB2-NIW I-140 allow you to work

Published Aug 21,2018 By Rubina Pal

I am planning to apply for EB2-NIW i.e., I apply only for I-140 and not I-485. I am already in the US on L2 with a valid EAD. But my L2 visa and EAD will expire in six months. When my current EAD expires, can I continue working in the US if I get I-140 approved by then?

Hi Rubina,

If your EAD expires, you will not be allowed to work, even if I-140 is approved. Please feel free to ask further questions in this thread.
