Summary of Visa Bulletin Relevant to EB1A and NIW

EB1 is current for all countries
EB2 is current for all countries except for India and China.  EB2 cutoff date for  China has advanced to 22 September 2005 . Cutoff date for India remains the same (1 February 2005).

I heard that Jeff Flake, Republican Congressman from Arizona mentioned those foreign nationals having completed PhDs in science, technology, engineering and mathematics (STEM) would be eligible to directly apply green card.

So I just wonder if there is any update on this issue?

There is a legislation in congress called “Stopping Trained in America PhDs from Leaving the Economy (STAPLE) Act (HR 1791)”. It was last referred to the Subcommittee on Immigration, Citizenship, Refugees, Border Security, and International Law in April of 2009. We are not aware of any action on this legislation yet.
