I would like to apply thru self-petition for EB1A for Ph.D from India. I have no clue how to proceed with the filing of I-140. Dates are current now. Presently, being in India, filing should be done in India, I guess.
What are the steps to be followed for filing of I-140 for EB1A from outside USA, where – Address the application and documents to be sent;
Premium Processing can be filed?
List of required documents;
Can we file concurrently, detailed info with procedure;
Parole and EAD if required, then how?
Medical and fingerprints and family applications all can be filed together?
Personal checks or other mode of payment?
How much time can be taken?
Interview and which consulate in India to contact, and any other info required… Please advise accordingly. Thank you.
Please keep in mind that you should not apply for advance parole, EAD or adjustment of status if you do not reside in the U.S. – these terms apply to the U.S. residents only. You will have to file all the paperwork for I-140 first (select consular processing in Part 4). Then, after I-140 is approved, USCIS forwards the documents to the National Visa Center (NVC). After NVC reviewed the paperwork and while the priority date is current, you and your dependents should apply for the immigrant visa (green card) in the consulate in India. These steps are explained at the Department of State website above.
