Received a letter requesting the ETA-750

Question:
After submitting I-140 I have been requested to submit form ETA-750. or ETA form 9089 . Can you please let me know why I was asked to submit these as these are used for labor certification. When I ‘m submitting the required forms is there any thing special I have to focus?

Answer:
Normally this form is not required when you self-petition in EB1a or EB2NIW. Your petition packet should include a section mentioning why you should be exempt from requiring labor certification. However some petition examiner send a RFE letter asking for a ETA-750b. You can fill one and send it as requested by the RFE. You should also mention in the response that you are self-petitioning in NIW and argue that requiring labor certification process would adversely national interest.

I have received the same letter for my self petition. Did you submit any additional evidence or simply filled the form out? I will appreciate the help as I am self-petitioning too. How long did they take for a decision after you submitted the form?

If the RFE only asks you submit a ETA-750, you fill out the form and include a cover letter. Usually USCIS take 1 to 3 months depending on the case, processing time and RFE.

Hello,
In response to my EB2-NIW petition, I received an RFE asking me to submit ETA-750 or ETA-9089 parts J, K, and L. I am planning to submit ETA-9089 because ETA-750b appears to be expired. I would appreciate if you could suggest me whether I can complete only those three parts (leaving the rest blank) in ETA-9089 ?
Yes, if USCIS requested ETA-9089 parts J, K, and L only, then this is what is supposed to be sent to them. ETA-750 is, indeed, the old version of the form and was superseded by ETA-9089.
