EB1a high salary

Published Jul 8,2018 By ruchi

Hi

I am post-doc(material science) at the national lab and interested in filling the Eb1a. I have following questions

  1. My profile is very similar to mentioned in the example mentioned on your site. (

    Chemistry Post-doctoral researcher at a National lab having  higher remuneration compared to normal post-doc salaries

    So I want to know how can I show the high salary. To do this which package of Eb1a I should buy from you which will help me in preparing documentation about this?

  2. In case of RFE do you help and if so how can we utilize the services?

Regards
Ruchi

Hi Ruchi,

To assist in determining that the beneficiary’s salary or remuneration is high relative to others working in the field, the petitioner may submit:
[*] Copies of the beneficiary’s W-2 or 1099 forms for years in which the beneficiary has received a high salary in the field of endeavor. Alternatively, the petitioner may provide similar foreign tax documents which establish yearly wages earned outside the U.S.
[*] Media reports of notably high salaries earned by others in the beneficiary’s field.
[*] List compiled by credible professional organization(s) of the top earners in a field.
[*] Geographical or position appropriate compensation surveys;
[*] Organization justifications to pay above the compensation data;
[*] Information from the U.S. Department of Labor or similar sources that show the comparison of salaries within states, between states, etc.
Note: U.S. Department of Labor prevailing wage rate information alone does not generally establish whether the salary or other remuneration is “significantly” higher than that of others in the field. If U.S. Department of Labor prevailing wage rate information is submitted, it should be accompanied by other corroborative evidence showing that the wage rate is high relative to others working in the field.

We have only one EB1A packet (manual + examples). It comes either alone or in combination with EB2-NIW packet. Please note that the examples do not contain evidences for this criterion, since it is rare that a petitioner successfully proves it. In case of RFE, you can use our review services (same link as the manual pricing). We would like to emphasize, that we do not provide a legal advice and all our opinions are for information purposes only. You can also ask further questions about our services by the email: greencardforphd (at) gmail.com
